The owner and administrator of the GamePulse.pl platform is Rafał Krupa, hereinafter referred to as “GamePulse”.
The GamePulse.pl platform provides technical tools enabling the transfer of digital gifts in the form of game keys for the Steam platform.
GamePulse:
provides a pool of gifts,
stores the gifts,
performs their technical delivery,
does not decide on the selection of gift recipients.
The decision regarding the recipient of a gift is made by the streamer using the GamePulse.pl platform, in accordance with the rules set out in these Regulations.
The transfer of gifts via GamePulse.pl does not constitute a sales promotion or a contest organized by GamePulse; GamePulse provides solely technical tools to execute transfers initiated by the Streamer.
Funder and Technical Operator – GamePulse
An entity providing the pool of gifts and performing their technical delivery.
Gift Transfer Organizer – Streamer
A person operating a channel who independently and at their own discretion indicates the gift recipient or uses other gift transfer modes available on the platform, in compliance with the law applicable to them.
Recipient – Viewer
A person explicitly indicated by the Organizer as the gift recipient, or indicated in accordance with the transfer mode chosen by the Organizer, as permitted by the laws applicable in the relevant jurisdiction.
Gifts transferred via the GamePulse.pl platform have the nature of a discretionary transfer (gift) or a donation.
Within the territory of the Republic of Poland, the transfer of a gift has the nature of a discretionary gift or a donation made by the Streamer to the Recipient, and GamePulse acts solely as a technical operator performing the delivery of the gift on behalf of the Streamer.
Gift transfers on the GamePulse.pl platform may take place in different modes depending on:
the streamer’s location,
the legal regulations applicable to them,
the functionalities available on the platform.
Within the territory of the Republic of Poland, gift transfers are not based on chance, are not automatic, and do not result from random mechanisms.
Outside the territory of the Republic of Poland, other gift transfer modes may be available, provided that they comply with the laws applicable in the relevant jurisdiction.
Streamers operating within the territory of the Republic of Poland:
may use only modes that do not involve any element of chance,
may transfer gifts exclusively to explicitly identified recipients.
Each streamer is assigned a predefined gift available within a specified time period.
The assignment and rotation of available gifts are organizational and administrative in nature and do not affect the selection of the gift recipient.
Indication of the Recipient within the territory of the Republic of Poland occurs exclusively through the manual execution by the Organizer of a dedicated system command containing the Recipient’s identifier.
Modes based on chance are unavailable for activities conducted within the territory of the Republic of Poland.
Gifts may be redeemed exclusively through the GamePulse.pl platform.
A technical condition for redeeming a gift is the authentication of the Recipient via a Twitch account.
Twitch account verification:
serves solely to confirm the Recipient’s identity,
does not influence the selection of the recipient,
does not constitute a criterion for granting the gift.
5.4. A gift recipient must be a natural person who has reached the age of 13 and possesses full or limited legal capacity.
5.5. In the case of gifts (game keys) subject to age restrictions (e.g. PEGI ratings), the Recipient confirms prior to redemption that they meet the age requirements specified by the game’s publisher or producer.
The Streamer, as the Gift Transfer Organizer:
decides on the selection of the Recipient or the gift transfer mode,
is responsible for communicating the rules to their community,
is responsible for compliance with the law applicable in their place of operation.
The right to indicate the gift recipient belongs exclusively to the streamer as the owner of the channel from which the system command is executed.
GamePulse:
does not interfere with the Organizer’s decisions,
does not apply random mechanisms within functionalities available to streamers conducting activities within the territory of the Republic of Poland,
is responsible solely for the technical delivery of the gift.
GamePulse is not liable for failure to deliver a gift due to reasons attributable to the Organizer, the Recipient, or external platforms (including Twitch or Steam).
The controller of personal data is GamePulse.
Only data necessary for the execution of the gift delivery process are processed, in particular the Twitch username assigned to gift redemption.
Data are processed for the purpose of:
technical gift delivery,
ensuring accountability of the process,
preventing abuse.
The legal basis for data processing is the legitimate interest of the controller (Article 6(1)(f) GDPR).
Data are not used for any other purposes and are not shared with third parties except for necessary technical integrations.
Recipients have no claim against GamePulse for the granting of a gift.
The Organizer’s decision regarding the transfer of a gift is final.
GamePulse does not guarantee the availability of specific gifts at a given time.
In the event of technical issues with gift redemption or detection of a defective key (e.g. a previously used code), the Recipient has the right to submit a complaint.
Complaints must be submitted exclusively via the official contact form available on the gamepulse.pl website.
A complaint should include:
the Twitch username (ID),
the name of the game concerned,
a brief description of the issue.
GamePulse will make reasonable efforts to review the complaint within 14 business days.
Due to the nature of the service, GamePulse, as a technical operator, may condition complaint handling on verification of the key status with external providers (e.g. Steam).
GamePulse reserves the right to amend these Regulations.
Use of the GamePulse.pl platform constitutes acceptance of these Regulations.
In matters not governed by these Regulations, Polish law shall apply with respect to the operation of the GamePulse.pl platform.
The streamer bears sole responsibility for ensuring that the method of transferring gifts complies with the laws applicable in the country in which they operate.
